Although Niche Flix, LLC is unlike any other online service, we do have some requirements that all subscribers must adhere to for us to guarantee the level of service you have come to expect from us.  By utilizing our service(s) (the service), all subscribers (subscribers) must adhere to our Terms of Service (terms of service) as outlined below and set forth herein  this document by Niche Flix, LLC (the provider).  You will be asked to agree with these terms before being allowed to utilize said Service.

General Rental Program Information

Must be 18 years of age or older to Subscribe.
There are no due dates or late fees.
There are no per-movie rental fees.
Membership fees cover shipping and handling on all your rentals.

You may cancel your account at anytime. All DVDs/Tapes must be returned within 7 days or risk being charged for them.
No refunds or credit will be given for partial periods or unused rentals.
All new customers will be under a 90-day probationary period and are responsible for any lost discs.

All discs MUST be returned inside their cardboard pad.  Failure to do so will cause you to be charged for any damaged discs received.

$5 fee for non-returned d-vhs cases and $10 fee for non-returned color filters.

$2 charge for discs returned without the disc sleeve and a $3 charge for discs returned in the wrong sleeve.

DO NOT use skip removal devices on Niche Flix LLC discs.  You WILL be charged full replacement costs for Defacement.

We reserve the right to refuse service and/or terminate accounts without prior notice at our sole discretion.

Gift certificate

After you have used all your gift subscription months, you will be automatically enrolled as a paying NicheFlix member. To avoid any charges, simply cancel your account in the last month of your gift subscription.

CONSENT TO JURISDICTION

   Any claim relating to this site, the use thereof and/or the materials contained herein is governed by the laws of the State of Indiana, U.S.A.  By accessing or using this site, you hereby consent to the exclusive jurisdiction of the state and federal courts located in Indianapolis, Marion County, Indiana, U.S.A., for resolution of any dispute you have with or relating to this site, or the goods offered and or rented herein.

   By accessing or using this site, you are further consenting to pay the legal costs of collection if Niche Flix, LLC is the prevailing party in any legal dispute arising out of any transaction involving Niche Flix, LLC.  These costs include, but are not limited to, legal fees, court costs, and actual damages.

   Further, by using this site you hereby consent to jurisdiction within Indianapolis, Marion County, Indiana, U.S.A., if for any reason Nicheflix.com is required to pursue legal action against you to recover a rented item or the value thereof.

   You will be charged for any rented item which is not returned within seven days of the cancellation of your account. You may cancel your account at any time.  Additionally, your account will be deemed canceled if your monthly payment transaction is denied.  If, after this specified time period has passed and the rented items are not returned, Nicheflix.com reserves the right to pursue the matter in a court of law.  The unreturned items may be considered converted and you will be responsible for the value of the items, plus all fees and fines.  In addition, because Niche Flix, LLC deals with rare and hard to find movies, you will be subject to a $100.00 re-stocking fee for each unreturned item.
